“PPP loans are widely available, but the government has decided not to subsidize certain types of businesses, even if they engage in constitutionally protected activities,” according to the decision. “The government does not violate a complainant’s rights by refusing to subsidize their First Amendment activities.”
“It appears that the 2nd Circuit Court of Appeal has done everything possible to avoid the United States Supreme Court cases that we have cited in support of our case,” said lawyer Steven M. Cohen, who represented the Pharaoh. “We are troubled by the decision and are considering our options.”
Owner cannot enterr Pharaoh
Peter Gerace Jr., owner of Pharaoh, was arrested earlier this week while in Florida on vacation. He is charged with drug trafficking, bribing a Buffalo Drug Enforcement Administration agent, continuing his drug business and conspiring to commit sex trafficking.
Gerace, 53, of Clarence, pleaded not guilty on Thursday.
His defense attorney has asked US Magistrate Judge Michael J. Roemer to allow Gerace to visit Pharaoh for three hours a day to take care of his business and paperwork for his 100 employees.
